FRESNO, Calif. (KFSN) -- California's list of low-performing schools is out after threats of a lawsuit.
The list allows parents to move their children to better-performing schools under the Open Enrollment Act.
Last year, the Department of Education indicated it would not release the list because the Academic Performance Index on which the list was based had been suspended. But the action drew sharp criticism from school improvement groups.
Last week, the Department of Education changed its notice and posted the list of 1,000 low-performing schools based on 2013 test. It includes 38 schools in Fresno County.
